Terms of service

English translation of the Italian General Terms of Sale, provided for convenience. In case of any discrepancy, the Italian version prevails.

The offer and sale of products on the website www.dasimo.it are governed by these General Terms of Sale. For other legal information, please see the Privacy, Shipping, Returns & refunds and Right of withdrawal pages.

Before sending an order, the Customer must read these terms carefully. Sending the order implies knowledge and acceptance of the General Terms of Sale and of the information given in the order form. Once the purchase is complete, we invite the Customer to print or save these terms and the order summary.

1. Purpose

These General Terms of Sale govern the online sale of products, through an e-commerce service, on the website www.dasimo.it.

Simona Mariani (sole proprietorship, trading as "Da Simo") ships within Italy, including the Republic of San Marino and Vatican City, and abroad. The sale price is always shown in euros, including for sales abroad. The shipping cost may vary depending on the country of destination.

2. Parties

The products are sold directly by Simona Mariani (sole proprietorship, trading as "Da Simo"), with registered office at Via di Parione 34, 00186 Rome (RM), Italy, registered with the Rome Companies Register, VAT number IT12979501009 (hereinafter "the Seller"). For any information, the Customer can write to the Seller at info@dasimo.it.

These terms govern the offer, submission and acceptance of purchase orders for products on the website. They do not govern the supply of services or the sale of products by parties other than the Seller that may appear on the website through links, banners or other connections. Before buying from parties other than the Seller, we recommend checking their terms of sale: the Seller is not responsible for services provided by third parties.

The products are sold to the Customer identified by the data entered in the order form, completed and sent electronically with simultaneous acceptance of these terms.

The offers on the website are aimed at customers of legal age. Anyone under 18 may purchase only with the consent of a parent or legal guardian. By sending an order, the Customer declares to be of legal age and to have the legal capacity to enter into binding contracts.

The Customer may not enter false, invented or fictitious names in the ordering process or in subsequent communications. The Seller reserves the right to take legal action against any violation or abuse, in the interest and for the protection of all consumers.

The Customer is solely responsible for the accuracy of the data entered in the order and releases the Seller from any liability for tax documents issued incorrectly because of incorrect data provided by the Customer.

3. Sale through e-commerce

An online sales contract is a distance contract for the sale of movable goods (hereinafter "Products"), concluded between the Customer and the Seller within an e-commerce service organised by the Seller over the Internet.

To conclude the purchase contract for one or more Products, the Customer completes the electronic order form (hereinafter "Order") and sends it to the Seller through the website, following the instructions given.

The Order contains:

  • a reference to these General Terms of Sale, including how and when Products can be returned and the conditions for exercising the right of withdrawal;
  • the information and images of each Product and its price;
  • the payment methods the Customer can use;
  • the delivery methods for the Products and the related shipping costs.

The Seller takes every measure to ensure that the photographs shown on the website faithfully reproduce the original products. Some variations are nevertheless possible because of the technical characteristics and colour rendering of the device used by the Customer. The Seller is therefore not responsible for any inadequacy of the images due to such technical reasons: the images are for illustrative purposes.

Before concluding the contract, the Customer is asked to confirm having read the General Terms of Sale, including the information on the right of withdrawal and on the processing of personal data.

The contract is concluded when the Seller receives the Order from the Customer through the website, after checking that the Order data are correct. The contract is governed by Italian law.

4. Order processing

By sending the Order, the Customer accepts these General Terms of Sale and undertakes to comply with them in dealings with the Seller.

Once the contract is concluded, the Seller sends the Customer an Order Confirmation by email, summarising the information contained in the Order. Before sending the confirmation, the Seller may ask the Customer, by email or by phone, for further information about the Order.

The Seller may decline orders that do not offer sufficient guarantees of solvency, that are incomplete or incorrect, or if the Products are unavailable. In these cases the Seller informs the Customer by email that the contract has not been concluded, stating the reasons, and the amount reserved on the Customer's payment method is released.

If the Products shown on the website are no longer available after the Order has been sent, the Seller informs the Customer as soon as possible and in any case within 30 days of the Order being sent. In this case the amount charged is refunded.

Each sale may concern one or more Products, with no quantity limit per item.

The Seller reserves the right to refuse orders from a Customer with whom a legal dispute concerning a previous order is pending, who has previously breached the conditions of purchase on the website, or who has been involved in fraudulent activities.

5. Sale prices

Unless otherwise stated in writing, all prices of the Products and shipping costs shown on the website and in the Order are in euros and include VAT. The valid prices are those shown on the website when the Order is sent. Prices of Products and shipping costs may change without notice: the Customer should check the final price before sending the Order.

All Products are shipped from Italy. For shipments to non-EU countries, or to countries whose laws provide for import charges, prices do not include any customs duties and related taxes: these costs are borne by the Customer and are paid on delivery.

6. Payment methods

The Customer can pay for the Products and the shipping costs with one of the methods shown when ordering.

The Seller accepts payments by credit, debit and prepaid card and with the other methods shown at checkout (for example Apple Pay, Google Pay and Klarna). The Seller does not charge any extra fee for the payment method chosen. The card must be valid at the time of the order. Except for payments with Klarna, which follow the plan chosen by the Customer, the amount is charged when the Order is sent.

If the Customer exercises the right of withdrawal after payment, the Seller credits the amount to be refunded to the same payment method used for the purchase.

At no point in the purchasing process can the Seller see the Customer's card details, which are transmitted over a protected, encrypted connection directly to the electronic payment provider. No archive of the Seller stores these data. The Seller cannot therefore be held responsible for any fraudulent or improper use of cards by third parties.

7. Shipping and delivery

Each shipment contains the ordered Products, the transport document or accompanying invoice, any documentation required by the country of destination and any informational material.

The Products are delivered by the courier chosen by the Seller to the shipping address given by the Customer in the Order. Costs, times, shipping methods and countries served are shown on the Shipping page.

On delivery, the Customer should check that the parcel is intact. If anything is wrong, the Customer should have the courier note it and may refuse the delivery, informing the Seller straight away.

8. Right of withdrawal

A Customer purchasing as a Consumer (that is, a natural person acting for purposes unrelated to their business or professional activity) has the right to withdraw from the contract, without penalty and without giving any reason, within 14 days of the day on which they receive the Products.

To exercise the right of withdrawal, the Customer sends, within this period, an email to info@dasimo.it stating the Order number and the items concerned. After this notice, the Customer receives the instructions for returning the Products.

The right of withdrawal is subject to the following conditions:

  • the Products must be returned intact and complete with all their parts;
  • the Products must not have been used or damaged;
  • the Products must be returned in their original packaging, with their tags;
  • Products from the same Order must be returned in a single shipment;
  • the Products must be handed to the courier within 14 days of the date on which the Customer gave notice of withdrawal.

In the event of a return, the shipping costs for the return are borne by the Customer, who may use the courier of their choice. Returns must be sent to: Simona Mariani (sole proprietorship, trading as "Da Simo"), Da Simo, Via di Parione 34, 00186 Rome (RM), Italy.

If the Products were damaged in transit or the Seller made a mistake in the shipment, the return costs are borne by the Seller.

The refund is made with the same payment method used for the purchase, after the Seller has received and checked the Products.

The right of withdrawal does not apply to products personalised at the Customer's request. More details on the Right of withdrawal and Returns & refunds pages.

9. Legal guarantee of conformity

The Seller is responsible for any lack of conformity of the Products sold on the website, including any mismatch between the items delivered and those ordered, as provided by Italian law.

For a Customer purchasing as a Consumer, the guarantee covers defects that appear within 24 months of delivery of the Products. In the event of a lack of conformity, the Customer is entitled to have conformity restored free of charge, by repair or replacement, or to an appropriate price reduction or termination of the contract, under the terms of the Italian Consumer Code.

The costs of returning defective Products are borne by the Seller.

10. Contact

For any information, the Customer can write to info@dasimo.it.

11. Communications to the Customer

The Customer agrees that all communications, notices, information and documentation relating to purchases will be sent to the email address given when ordering.

12. Privacy

Information on the processing of personal data is available on the Privacy page.

13. Governing law and jurisdiction

These General Terms of Sale are governed by Italian law, without prejudice to any more favourable mandatory rules of the country where the consumer Customer habitually resides.

If the Customer is a Consumer, any dispute falls within the jurisdiction of the court of the Customer's place of residence or domicile. If the Customer acts in the course of their business, commercial, craft or professional activity, the Court of Rome has exclusive jurisdiction.

14. Changes and updates

The Seller may change these General Terms of Sale at any time. The Customer is subject to the terms in force at the time of purchase. New terms take effect from the date of publication on the website and apply to orders sent after that date.
